We process this data to supply the goods and/or services you have purchased and to keep records of such transactions. Our lawful basis for undertaking this processing activity is the fulfilment of a contractual agreement between you and us, and/or the initiation of measures, as per your request, to engage in said contractual arrangement.
  • User Data includes data about how you use our website and any online services together with any data that you post for publication on our website or through other online services. We process this data to operate our website and ensure relevant content is provided to you, to ensure the security of our website, to maintain back-ups of our website and/or databases and to enable publication and administration of our website, other online services and business. Our lawful basis for this processing is our legitimate interests which in this case are to enable us to correctly administer our website and business.

  • Sensitive Data: We need to collect and process sensitive data including but not limited to your health information, diet and lifestyle choices, biochemical health test results, medical diagnoses, family history, supplements and medication details, clinical notes, health plans and GP contact information, as a part of the services we provide, which in this case are legitimate interests to enable us to deliver nutritional therapy and education, and coaching services.

    The Essential Nutritionist provides nutritional therapy, neuro-linguistic and energy therapy (Reiki) services to our clients to improve their health through nutrition and lifestyle interventions. Our focus is on preventative healthcare, the optimisation of physical and mental health, and supporting the management of chronic health conditions.

    We require your explicit consent for processing sensitive data, so when you submit your details, we will send you a further communication asking for you to confirm your consent to this processing.

    Where we are required to collect personal data by law, or under the terms of the contract between us and you do not provide us with that data when requested, we may not be able to perform the contract (for example, to deliver goods or services to you). If you do not provide us with the requested data, we may have the right to cancel a product or service you have ordered but if we do, we will notify you at the time.

    We will only use your personal data for a purpose it was collected for or a reasonably compatible purpose if necessary.     We may collect data about you by you providing the data directly to us (for example by filling in forms on our site, by filling in forms such as health questionnaires or test requests sent to you by us or directly by third-party providers, during consultations either online or in person, through telephone calls, or by sending us emails or digital communications).     We may receive data from third parties such as test results sent directly to us by third-party providers, analytics providers such as Google based outside the UK and/or the EU, advertising networks such as such as Facebook, Twitter (X), Linkedin and YouTube based outside the UK and/or the EU, such as search information providers such as Google/Safari etc based outside the UK and/or the EU, providers of technical, payment and delivery services, such as data brokers or aggregators.

  1. MARKETING COMMUNICATIONS  
    Our lawful basis for processing your personal data is to send you marketing communications is either your consent or our legitimate interests (namely to grow our business). 

    Under the Privacy and Electronic Communications Regulations, we may send you marketing communications from us if (i) you made a purchase or asked for information from us about our goods or services or (ii) you agreed to receive marketing communications and, in each case, you have not opted out of receiving such communications since. Under these regulations, if you are a limited company, we may send you marketing emails without your consent. However, you can still opt out of receiving marketing emails from us at any time. 

    Before we share your personal data with any third party for their own marketing purposes, we will get your express consent.

  1. DISCLOSURES OF YOUR PERSONAL DATA

    Service providers who provide functional testing, or supplements, in agreement with you.

    • Professional advisers including lawyers, bankers, auditors and insurers.Government bodies that require us to report processing activities.Registration bodies or professional associations, for the for the processing of a complaint made by you.Third parties to whom we sell, transfer or merge parts of our business or our assets.

    • Your GP or medical healthcare providers. We will seek your express consent before sharing your information. 

      We require all third parties to whom we transfer your data to respect the security of your personal data, where provided (and not anonymised) and to treat it in accordance with the law. We only allow such third parties to process your personal data for specified purposes and in accordance with our instructions.

      However, if we believe that your life is in danger then we may pass your information onto an appropriate authority (such as the police, social services in the case of a child or vulnerable adult, or GP in case of self-harm) using the legal basis of vital interests.

      We may share your case history in an anonymised form with our peers for the purpose of professional development.  This may be at clinical supervision meetings, conferences, online forums, and through publishing in medical journals, trade magazines or online professional sites.  We will seek your explicit consent before processing your data in this way.

They will only process your personal data on our instructions and they must keep it confidential.

    We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, insurance, tax or reporting requirements or as required by professional bodies.
